F.S. Section 83.63 (Casualty): If a hurricane or other casualty damages the premises through no fault of the tenant and enjoyment is substantially impaired, the tenant may terminate and immediately vacate or vacate only the unusable part. If only part is unusable, the tenant's rent is reduced by the fair rental value of that part.
Partial use / staying put: When you remain in a partially usable unit, rent is reduced in proportion to the loss of rental value (no fixed formula). F.S. Section 83.56(1)(b).
Notice: § 83.63 (casualty damage) is different from § 83.56 (landlord noncompliance). § 83.63 describes options when a casualty event substantially impairs enjoyment (terminate and vacate, or vacate only the damaged portion with rent reduced by the fair rental value of that portion). § 83.56 provides a separate notice-and-cure framework for landlord noncompliance, and § 83.56(1)(b) describes proportional rent reduction when the unit is not rendered untenantable and the tenant remains in occupancy. You've selected ALL bathrooms as unusable. If all bathrooms are unusable, the home may be considered not reasonably habitable because basic sanitation is unavailable. This tool treats this as 100% impact for the affected days (conservative). (Informational only — not legal advice.)
Legal considerations:
A dwelling with zero functional bathrooms is considered uninhabitable under Florida law. Your claim will be significantly stronger with third-party verification (code enforcement, FEMA, etc.). This is not legal advice consult an attorney for your specific situation.
We noticed your 2nd incident overlaps with incident #1. Please review this important information to ensure your claim is accurate.
If Incident #2 affected the same areas that were still damaged from Incident #1, consider extending the end date of Incident #1 instead of adding a separate incident. This ensures accurate documentation.
